1. Eligibility & Accounts

1.1 Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase a subscription or use our Services. By using our site, you represent that you meet this age requirement. If you are under 18, you may use the Services only with involvement of a parent or legal guardian. We do not knowingly sell to children; see our Privacy Policy regarding minors.

1.2 Account Registration: Purchasing a Seoul Beauty Club subscription may require creating an account. You agree to provide accurate, current information (such as name, shipping address, payment details) and to keep it updated. You are responsible for maintaining the confidentiality of your account login and for all activities that occur under your account. Please notify us immediately of any unauthorized use of your account.

1.3 Account Use: You agree not to impersonate anyone or use another person's account. We reserve the right to suspend or terminate any account we suspect is involved in fraudulent or unauthorized activity, or if account information is inaccurate or violates these Terms.

2. Subscription Terms & Billing

2.1 Recurring Subscription: Seoul Beauty Club is an ongoing subscription service. When you pre-order and subscribe, you are signing up to receive a box on a recurring basis (e.g., monthly) until you cancel. Your subscription will automatically renew each billing period, and you will be charged for each renewal until you cancel. If you subscribe for a membership with a fixed term (e.g. annual or quarterly), you will not be able to cancel your payment before the end of such term.

2.2 Billing & Charges: For the first box (pre-order), your provided payment method is charged at the time of checkout to secure your order. Subsequent boxes will be charged on a recurring billing date (for example, on the 15th of each month or another set schedule). You agree that we may save and charge your payment method for each renewal without further authorization, until you cancel. All prices are in USD and subject to applicable taxes. If any payment fails, we may retry or contact you for an update.

2.3 Pricing Changes: Prices for the subscription or shipping may change over time. If the price of your subscription changes, we will notify you in advance (for example, by email or site notice). Price changes will apply to future charges (we will not retroactively charge you more for already-paid orders). If you do not agree with a price change, you may cancel before the new price takes effect. Continuing to receive the service after the price change is implemented constitutes your acceptance of the new pricing.

2.4 Promotions & Discounts: From time to time, we may offer introductory pricing, discount codes, or promotions for new subscribers. Such offers are subject to their own terms and may be limited to one per customer. If you violate the terms of a promotion, we reserve the right to charge full price or cancel your order.

3. Shipping & Delivery

3.1 Shipping Schedule: Pre-ordered boxes will ship starting on the date advertised (for the first box, May 31, 2025). Subsequent subscription boxes typically ship around end-month of each cycle (e.g., around the last date of each month for monthly subscriptions). We will communicate the general shipping schedule on our site or FAQ. Actual ship dates may vary slightly and are subject to change – if we need to adjust timing (e.g., due to inventory or logistics issues), we will let subscribers know in advance when possible.

3.2 Delivery: We ship from Seoul, South Korea to U.S. addresses only (including all U.S. states; at this time we do not ship internationally outside the U.S.). Please allow an estimated 3–10 business days for delivery after a box ships. Delivery times can vary based on the carrier and destination.

3.3 Risk of Loss: Once we hand off your package to the shipping carrier, risk of loss transfers to you. This means you are responsible for any loss or damage during transit. However, we will do our best to help if something goes wrong.

4. Cancellation Policy

4.1 Cancel Anytime: You may cancel your Seoul Beauty Club subscription at any time, effective for the next billing cycle. There are no cancellation fees. To cancel, log in to your account settings and follow the cancellation process, or contact our customer support team before your next billing date.

4.2 No Refund for Processed Orders: Cancelling your subscription does not retroactively refund payments for any boxes that have already been billed and are being processed. In other words, if you've been charged for a box and then decide to cancel, that charge will not be refunded (because that box is already being prepared for you).

5. User Conduct and Site Use

5.1 Permitted Use: You may use our website and Services for your personal, non-commercial use in compliance with these Terms. You agree not to misuse the site. For example, you will not:

• Interfere with the normal operation of the site or attempt to access it using a method other than the interface and instructions we provide.

• Engage in any fraudulent or illegal activities on the site, including making false orders or attempting to scam the Company or other users.

• Copy, distribute, or create derivative works from any part of our website content without our prior written permission.

• Use any automated means (robots, scrapers) to collect information from our site without authorization.

• Upload or transmit any malicious code, or do anything that could harm our systems or the experience of other users.

6. Intellectual Property

6.1 Our Content: All content on the Seoul Beauty Club website and materials included in the subscription box (such as logos, graphics, text, design, product information) are the intellectual property of Seoul Beauty Club or our content suppliers and are protected by copyright, trademark, and other intellectual property laws. 7. Disclaimer of Warranties

7.1 “As Is” Basis: The site, Services, and all products you receive from Seoul Beauty Club are provided “as is” and “as available,” without any warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

7.2 No Medical or Skin Advice: The content we provide (on our site or in-box materials) is for informational purposes only. We are not giving medical, dermatological, or professional advice. Skincare and cosmetic products can affect individuals differently. Always read product labels, patch test new skincare if needed, and use as directed. If you have specific skin conditions or allergies, consult a healthcare professional. Use the products at your own risk.

8. Limitation of Liability

8.1 No Indirect Damages: To the maximum extent permitted by law, Seoul Beauty Club (and our employees, affiliates, partners, and vendors) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the site or receipt of the subscription boxes.

8.2 Cap on Liability: Our total aggregate liability for any claim arising from your use of our Services or products is limited to the amount you paid us for that product or service in the twelve months leading up to the claim.

9. Dispute Resolution & Arbitration Agreement

9.1 Governing Law: These Terms and any disputes arising out of your use of the Services are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles.

9.2 Initial Dispute Resolution: We are committed to customer satisfaction. Most concerns can be resolved quickly by contacting our support team at support@seoulbeautyclub.com. You agree to try to resolve any dispute informally by contacting us before initiating formal legal action.

9.3 Binding Arbitration: ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES WILL BE RESOLVED BY BINDING ARBITRATION, NOT IN COURT. You and Seoul Beauty Club agree to waive the right to a trial by jury and to participate in a class action for all covered claims.
